In order to use the app and services please read these terms of use (“Terms”) and our Privacy Policy Privacy Policy carefully. By downloading accessing and using the App and the services offered therein, you consent to these Terms. IF YOU DISAGREE WITH THESE TERMS, IN WHOLE OR IN PART, PLEASE REFRAIN FROM USING THE APP AND SERVICES AS DESCRIBED BELOW.

These Terms are the legal agreement between us, the developer and owner of the mobile application (“we” or “us”, and “App”) and any individual who wish to use the App (“User”, “you”). 

The App is offered to users aged 18 or older (or the age of legal age as apply in your jurisdiction). In order to use the App, you confirm that you are at least 18 years or the legal age apply in your jurisdiction when entering into these Terms.

1. SERVICES 

2.1. Our App provides a diverse range of functionalities, features, and content (collectively hereinafter referred to as the "Services"). The Services are designed to enhance user experience, facilitate engagement, and provide value within the App's ecosystem.

2.2. The Services are primarily accessible when an active internet connection is available. Users may experience limited or no functionality in the absence of internet connectivity. We cannot guarantee uninterrupted access to the Services due to factors beyond our control, including but not limited to network outages or device limitations.

2.3. We retain the right, in our sole discretion and in accordance with these Terms, to:

2.3.1. Determine the scope and nature of features, settings, pricing models, and tools offered as part of the Services; and

2.3.2. Implement changes to the Services, including but not limited to: (i) modifying existing features or functionalities; (ii) correcting errors or bugs; (iii) amending user interfaces or experiences; (iv) updating system requirements or compatibility; (v) upgrading performance or security measures; (vi) improving user experience or efficiency; (vii) removing outdated or underutilized features; (viii) replacing components with enhanced alternatives; and (ix) introducing new capabilities or content. While we strive to provide notice of significant changes, we are not obligated to inform users of every modification made to the Services. Continued use of the Services following any changes constitutes acceptance of such modifications.

2. INTELLECTUAL PROPERTY 

2.1. All intellectual property rights associated with the App and our Services, including but not limited to trademarks, patents, copyrights, trade secrets, domain names, logos, layouts, source codes, algorithms, databases, and content, whether registered or unregistered, are the exclusive property of us.

2.2. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the App and Services for personal, non-commercial purposes. This license does not permit sublicensing, assignment, or transfer to any third party.

3. THIRD-PARTY LINKS 

Our Services may incorporate links to third-party websites, sources, or applications. Activating these links may direct you to external platforms. Your use of any third-party services is governed by their respective terms of service and privacy policies. We bear no responsibility or liability for your interactions with these external services. We encourage you to review the terms and privacy policies of any third-party services you access through our App to understand your rights and obligations.

4. USERS RESTRICTIONS

Users must use the Services in accordance with all applicable laws and regulations, and strictly forbidden from: 

4.1. Interfering with, damaging, or disrupting any aspect of the Services. 

4.2. Transmitting or uploading any malicious software or harmful programs. 

4.3. Reproducing, distributing, or attempting to commercialize any component of our Services.

4.4. Infringing upon the intellectual property rights or legitimate interests of others.

These restrictions aim to maintain a safe, equitable, and enjoyable environment for all users while preserving the integrity of our Services and respecting third-party rights.

5. DISCLAIMER OF WARRANTIES

5.1. Users acknowledge that no digital service can guarantee uninterrupted availability or absolute security.

5.2. We are not responsible for Service failures, interruptions, or discontinuations resulting from: a) Inherent limitations of internet technologies b) Force majeure events c) Cyberattacks or malware d) System vulnerabilities e) Third-party service failures f) Other factors beyond our reasonable control.

5.3. To the fullest extent permitted by law, we disclaim liability for any indirect, special, consequential, or punitive damages, including but not limited to lost profits or revenues.

6. LIMITATION OF LIABILITY 

To the maximum extent allowed by law, we shall not be held liable for any indirect, incidental, consequential, special, or exemplary damages, this includes, but is not limited to: (i) Lost profits; (ii) Data loss; (iii) Business interruption; (iv) Loss of opportunities; (v) Damage to goodwill; and (vi) Other intangible losses. This limitation applies regardless of whether we have been advised of the possibility of such damages. Our total and aggregate liability shall not exceed $10 USD.

7. INDEMNIFICATION

Users agree to defend, indemnify, and hold harmless us, including our affiliates, directors, officers, employees, and representatives, against any and all liabilities, damages, losses, costs, fees (including reasonable legal fees), expenses, relating to claims arising from or in connection with any violation of these Terms.

8. GOVERNING LAW 

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any dispute shall be resolved exclusively in the courts of Tel Aviv, Israel.

9. GENERAL

If any provision of these Terms becomes unenforceable, that provision will be enforced to the maximum extent permissible to effectuate the intent of the Terms. The remainder of the Terms will continue in full force and effect. Users may not assign or transfer any rights and obligations under these Terms. We retain the right to assign or transfer our rights and obligations under these Terms. Our failure to enforce any provision of these Terms shall not constitute a waiver of future enforcement of that or any other provision. We reserve the right to amend these Terms from time to time. We will notify users of updates by publishing the revised Terms. For material changes, we will provide prominent notice within the App.
